2021 Regulation Changes – Cardona Decision

Any party or witness may choose not to offer evidence and/or answer questions at the hearing, either because they do not attend the hearing, or because they attend but refuse to participate in some or all The Decision-maker can only rely on whatever relevant evidence is available through the investigation and hearing in making the ultimate determination of responsibility. The Decision- maker may not draw any inference solely from a party’s or witness’s absence from the hearing or refusal to submit to cross-examination or answer other questions. (ATIXA 2021)

2020 Regulation Changes

The Department of Education has revamped regulations regarding the Title IX procedural operations and protocols that all colleges and universities that receive federal funding must be in compliance with by August 14, 2020.  The regulations aim to provide a higher level of due process to parties involved in sexual misconduct investigations on college campuses.  One of the largest shifts in procedures is the utilization of a live hearing and usage of cross examination between the parties involved with the allegations, in accordance with the guidelines for more due process.  WNMU’s Title IX Coordinator has been working to ensure that WNMU is in compliance with these federal regulations.  Below there are several documents that outline not only what the new regulations will look like, but also provide further insight into how they will be applied to the WNMU campus community.
